Breeder will provide paperwork when puppy is picked up. 

Paperwork must be signed at time when buyer picks up the dog. 

Unless agreed beforehand the breeder will submit registration paperwork to ASCA/AKC once breeder and buyer agree on a registered name for the puppy (registration fees are included in puppy price). If the buyer does not have a ASCA membership the breeder will pay for the buyer to become a "Service" member when puppies registration paperwork is submitted. If buyer wishes to be a "full member" they are responsible for additional fee and it is due when signing all paperwork at pick up. 

If puppy is purchased with full registration and buyer wishes to submit AKC/ASCA paperwork no fees will be credited/removed from puppy purchase price. 

We understand that not all breeders submit ASCA/AKC paperwork for buyers but we have found that many buyers who purchase "Pet" puppies normally do not submit paperwork. By us submitting the registration paperwork is our way of supporting registries. 

Please understand this is just a "basic draft" of our contract. 
Each puppy is sold individually and our contract can be revised for each situation.

I.Contractual Agreement
This contractual agreement is between Shannon Barnes-Envy Aussies, hereafter referred to as “Breeder” and _________________________, hereafter referred as “Buyer” for the sale and purchase of one purebred Australian Shepherd. 
The buyer agrees that they are responsible for all shipping and transportation costs, if applicable, to be remitted to the breeder prior to shipping of the dog. Personal checks will be accepted for deposit consideration. The remaining balance must be paid in cash, cashier’s check, or money order. 
It is agreed between breeder and buyer that this dog is being acquired as a family companion dog or as a working dog to be used for tasks appropriate to its breed. These tasks include herding, search and rescue, therapy, exhibition in conformation, obedience, Frisbee, flyball, rally, tracking, or agility competition. (We do not guarantee dog will earn titles)

II.Health:
The breeder warrants the dog to be in good health as of the time of sale. Further the breeder warrants that both sire and dam’s hips have been x-rayed and evaluated by the Orthopedic Foundation for Animals (OFA) in the United Sates, Penn Hip method or by the appropriate certifying body in “Country or Origin,” and have been founded to be of the grade of “Fair” or better by the Orthopedic Foundation for Animals and are free of canine hip dysplasia and that their eyes have been examined by a veterinary ophthalmologist and certified to be free from inherited eye disorders at the time of examination.  
Puppy will have been wormed and received his or her first round of shots and have an eye checkup.
If this animal is unable to obtain OFA Grade Fair or better and CERF clearance by virtue of hereditary defect prior to 36 months old, replacement puppy will be provided by Seller, at a time and choosing of Seller’s discretion. Replacement puppy will not be provided until written proof of OFA results and documentation from two board certified ophthalmologist veterinarians attesting to the genetic nature of any eye problem that would prohibit CERF clearance. Should this Australian Shepherd fail any of required health clearances, said animal must be spayed/neutered and returned to Envy Aussies to be re-homed into pet home, unless other arrangements, agreed upon in writing in advance by Breeder/Buyer, are made. Note that transportation of original dog back to Envy would be at buyers expense, transport of new replacement puppy must be at buyers’ expense, and all transportation methods must be mutually agreed upon in advance.

The buyer agrees that all shipping and transportation costs of the replacement pup are their responsibility and no animal will be shipped without these costs being remitted to the seller first. 
Only one replacement is given. All replacements are final. Replacement puppies are not transferable to any other party.
No replacement is honored after 36 months.

Seller strongly encourages purchaser to have the dog seen by a veterinarian of purchaser’s choice within 72 hours of picking up the dog. Said dog may be returned to the seller for any reason within the 72 hours following purchase. If the dog is returned in the same physical condition it was delivered in and has not been exposed to contagious diseases, the purchaser will then be entitled to a refund of the original purchase price. 

III.Ownership responsibilities:
1.The purchaser agrees to maintain the dog in a humane environment and properly train and care for the dog. Specifically the dog will be legally licensed and inoculated against rabies, distemper, and parvovirus. And other communicable diseases as recommended by a qualified licensed veterinarian. 
2.The purchaser agrees to maintain the dog on a commercial heartworm preventative on a schedule recommended for the specific region in which the dog will reside. Under no circumstances will the dog or puppy be administered liquid ivermectin, either orally or by injection as a means of heartworm preventative unless the dog has received the MDR1 sensitivity test and is found to be homozygous for normal genes.
3.The purchaser agrees that the dog will not be allowed to roam on neighboring properties and will be in a secured fenced area when unattended
4.The purchaser agrees to ensure that the puppy will be socialized with other animals and humans. 
5.The purchaser agrees that he/she is not acting as an agent of, nor will the purchase in turn sell this dog or it’s progeny to any pet store, dealer, wholesale outlet, known puppy mills, guard dog business or research facility. 
6.The purchaser agrees to not breed this dog to a mixed breed dog, or for toy or miniature or Miniature American Shepherds. 

IV.Registration:
The seller certifies that the dog is eligible for registration under regulations of the American Kennel Club and Australian Shepherd Club of America as a pure bred Australian Shepherd and will provide the proper forms for such a registration. The seller reserves the right to affix the kennel name “Envy” and supply a registry name for the dog. 
No other kennel name(s) shall be affixed to this dog registry name.

V.Terms of sale (Registration):  
(Not all apply, we will discuss what one will be for you ahead of time)
__________Pet registration (Altered): The sale of this puppy is the purpose of being a family companion and must be spayed / neutered. The dog can compete in in AKC/ASCA events as an altered dog/bitch. See contract requirements A for additional terms.

__________Co-ownership (intact):  The puppy from this agreement is not being sold on a straight altered contact. This animal is being sold as a possible “show quality” breedable animal. This dog is being sold to compete in AKC/ASCA events with the goal of earning a Champion title. Buyer understands they must meet contract requirements B in order to receive full registration. If buyer wishes to breed animal before champion title is earned they agree to requirements listed in this contract under requirements B.

__________Co-ownership-intact (breeder retains breeding rights):  The puppy from this agreement is not being sold on a straight altered contact. This animal is being sold as a possible “show quality” breedable animal. This dog is being sold to compete in AKC/ASCA events with the goal of earning a Champion title. Buyer understands that the dog being sold is there “Pet” but we/breeder retain breeding rights to the dog and will have access to the dog for training and to show in conformation and other venues of our choice. The buyer understands this dog must remain intact and if altered without breeders written permission they are responsible to pay the following as the full purchase price for the animal.$____________.

__________Full registration (intact): Buyer agrees that this dog will not be bred before the age of 2 years old. This animal has to be certified free of any hereditary eye defects on an annual basis. The Orthopedic Foundation for Animals or PENN Hip must certify this animal free of hip dysplasia.  
This puppy has been sold for the purpose of being shown in all venues of competition available for the Australian Shepherd including intact/altered conformation classes should the owner desire. The breeder will use his/her best judgment in evaluating the show or pet quality status for the represented dog. Due to the numerous circumstances involved in campaigning, maintaining and showing a dog, we will not guarantee that a “show quality” dog or puppy will be successful in the show ring as an adult and no warranties are made to that effect.

A. Pet Quality contract stipulations
If the dog is purchased as a companion (pet only), limited registration papers will be provided. 
Seller will keep co-ownership until proof of spay/neuter. Then Seller will transfer sole ownership to Buyer.

Dogs which are purchased solely as family companions (limited registration) should be spayed/neutered before 18 months of age.

B.Co-Ownership contract for intact Dog/Bitch 
Show Quality Dogs:
(Does not apply with co-ownership when breeder retains breeding rights)
This breeder will use his/her best judgment in evaluating the show or pet quality status for the represented dog. Due to the numerous circumstances involved in campaigning, maintaining and showing a dog, we will not guarantee that a “show quality” dog or puppy will be successful in the show ring as an adult and no warranties are made to that effect. 
The final price after all requirements are met will be $____________ to have the animal as a breedable animal/or puppy back (Full Registration). Co-ownership will be kept on puppies not going out on a straight altered contract
1.This puppy has been sold for the purpose of being shown in all venues of competition available for the Australian Shepherd including intact/altered conformation classes should the owner desire. It, however, is not to be bred unless an addendum to this contract is done in writing, an additional fee and all conditions below are met:
a. This animal has to be certified free of any hereditary eye defects on an annual basis.
b.The Orthopedic Foundation For Animals or PENN Hip must certify this animal free of hip dysplasia.
c.This animal must have a conformation championship in AKC or ASCA and/or titles in the obedience (CDX) or herding divisions OTDcs, ATDd. Or Agility titles in Open

Co-Ownership contract for intact bitch

If buyer wishes to breed bitch before Champion title is earned:
Breeder must approve all breedings
(If agreed by breeder, potential sire must be titled with either AKC/ASCA)
All health clearances OFA/CERF must be received and be clear of hereditary defects
Both buyer and seller agree that if bitch is to be bred before championship title is received a sire must be approved by breeder and breeder will receive second pick puppy from each litter that is whelped. 
Said puppy does not count as pick puppy or additional fee owed after bitch receives champion title.

VI.Breeding Before Health Clearances: 
Breeding before health clearances of OFA and CERF will not be allowed under any circumstance. If an accidental litter does occur the buyer will surrender all puppies to the breeder and all money made by sales will be retained by breeder (puppies will be registered with AKC/ASCA if allowable by registry).  
If breeding without health clearances continues after 1st litter buyer agrees to return said animal to breeder at buyer’s expense, and to sign over all registration papers and litter applications. 

VII.Right of recovery/placement
In the event that the purchasers are unable or unwilling to keep the dog or provide an appropriate home in accordance with this agreement due to any reason, including the death of the purchaser, the dog will be offered to the sellers first. Purchaser agrees he/she will not abandon the dog to a shelter, but shall contact the seller to assist in acting as agent to rehome the dog in an approved environment. 
If the breeder feels that dog is being neglected or in any danger breeder has the right to take dog/bitch back at any time and buyer must sign over all registration paperwork. 
Upon the event the dog is returned, the seller is under no obligation to refund any part of the purchase price. Both AKC and ASCA registration papers will be supplied and signed over to the breeder upon surrender of the animal. 
I/We, the Breeder/Buyer have read and understand the contents of this contract. I/We acknowledge this to be true and binding contract.
